These Terms of Service (“Terms”) govern your use of dearlegend.com and related services operated by Layf LLC (“Dear Legend,” “we,” “us,” or “our”). By using our services, you agree to these Terms.
1. Service Description
Dear Legend is a subscription service that delivers handwritten letters from fictional, historical, and mythical characters to your mailbox. Letters are generated by artificial intelligence and written by automated handwriting technology using real ink. Characters are creative interpretations and do not represent the actual views of historical persons.
2. Eligibility
You must be at least 18 years old to create an account and purchase a subscription. Subscriptions for minors must be purchased by a parent or legal guardian who accepts these Terms on their behalf.
3. Accounts and Subscriptions
- You are responsible for maintaining the accuracy of your account information.
- Subscriptions renew automatically at the end of each billing period unless cancelled.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- We do not offer refunds for partial billing periods.
4. Pricing and Payment
- All prices are in US dollars and include applicable postage.
- We reserve the right to change pricing with 30 days' notice to active subscribers.
- Overage charges ($4.99 per additional letter exchange beyond your plan limit) are billed on your next invoice.
- Payment is processed securely by Stripe. We do not store credit card information.
- Gift purchases are one-time payments and are non-refundable once the first letter has been sent.
5. Letter Content
- Letters are generated by AI and written in character. They are creative fiction, not factual historical documents.
- We strive to make all content appropriate for the intended recipient. Content for children is age-adjusted based on information you provide.
- You may specify topics to avoid, and we will make reasonable efforts to honor those requests.
- We reserve the right to refuse to generate content that is harmful, illegal, or inappropriate.
6. Return Mail
- Letters include a prepaid return envelope for recipients to write back.
- Return letters are scanned and processed to generate personalized responses.
- By writing back, you consent to the scanning and processing of your correspondence for the purpose of continuing the pen pal relationship.
- Physical return mail is securely destroyed after scanning.
7. SMS/Text Messages
If you opt in to SMS communications:
- You consent to receive recurring automated text messages from Dear Legend.
- Message and data rates may apply. Message frequency varies.
- Text STOP to unsubscribe at any time. Text HELP for help.
- SMS consent is not required for purchase.
- We will not share your phone number with third parties for marketing purposes.
8. Intellectual Property
All content, designs, and materials on dearlegend.com are owned by Layf LLC. Characters based on historical figures are in the public domain; our creative interpretations, personality prompts, and generated content are proprietary. You may not reproduce, distribute, or commercially use our content without permission.
9. User Conduct
You agree not to:
- Use the service for any unlawful purpose
- Provide false information or impersonate others
- Attempt to access other users' accounts or data
- Send threatening, abusive, or inappropriate content through return mail
- Resell or commercially exploit the service without authorization
10. Limitation of Liability
Dear Legend is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you've paid us in the 12 months preceding the claim.
11. Delivery
We make reasonable efforts to deliver letters within stated timeframes (typically 3-5 business days). Delivery times depend on USPS and are not guaranteed. We are not responsible for delays caused by postal services, incorrect addresses, or circumstances beyond our control.
12. Termination
We reserve the right to suspend or terminate your account if you violate these Terms. You may close your account at any time by cancelling your subscription and contacting hello@dearlegend.com.
13. Governing Law
These Terms are governed by the laws of the State of Delaware. Any disputes shall be resolved in the courts of Delaware.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or website notice. Continued use of the service after changes constitutes acceptance.
